EEOC Fines

Effective April 18, 2014, the Equal Employment Opportunity Commission (EEOC) has increased its fines from $110 per violation to $210 per violation.  This fine applies to employers who neglect to display the required EEO posters.  The posting requirements are for Title VII, the ADA, and GINA.  Here is a copy of the federally mandated poster.  If you don’t have it posted, please do so today!  http://www1.eeoc.gov/employers/upload/eeoc_self_print_poster.pdf

 

Flex Spending Use-or-Lose

The Treasury Department released an update to the Use-or-Lose rule for Flex Spending Accounts.

To make health FSAs more consumer-friendly and provide added flexibility, the updated guidance permits employers to allow plan participants to carry over up to $500 of their unused health FSA balances remaining at the end of a plan year.

Some plan sponsors may adopt a carryover provision as early as plan year 2013.

Diverse Connections

Studies have shown Diversity Workshops can divide employees.  Workshops often highlight the differences between cultures, generations and races. Although well intentioned, these workshops can increase employee conflict.

At San Antonio College, students participated in a Connections Workshop.  By communicating our proudest, happiest moments in life, we learned how much we share in common and just how connected we really are.

Computer Fraud

What recourse would you have if an employee stole your company’s proprietary data?

The Computer Fraud and Abuse Act (“CFAA”) has been used as a remedy by employers who experience a loss due to misuse of  computer data by disgruntled employees.

How successful you are in establishing your case depends on how narrowly the courts interpret the law.  More courts are narrowly interpreting the CFAA to cover only outside hacking of computers.  This means misuse by an employee, with authorized access to computer files, may not be covered.

How do you protect yourself?  Write your Non-Compete / Non-Disclosure Agreements with CFAA in mind.  Include that an employee’s authorization to access data ceases immediately upon triggered events i.e. fraudulent activity.

Consider hiring a forensic specialist immediately after a loss. An employee’s use of spyware or decryption tools will help establish a case for unlawful access.  A specialist may also help you determine if the evidence is strong enough to support a CFAA claim.

Employee Handbook Clinic

This SBDC PTAC (SBA) clinic is a hands-on event for the creation of an employee handbook. The first half of the seminar will identify key elements of an Employee Handbook. Utilizing an electronic template, each attendee will be able to create or revise their personnel policies with the direction and assistance of Human Resource Specialist. This clinic will allow you to focus your efforts without the interruptions that occur all the time in small businesses. Cost: $30
